NOVA Dance Competition ("we," "us," or "our") operates the website novadancecompetition.com (the "Site") and provides the ability to register for dance competitions, masterclasses, and related events, as well as access information regarding our services (the "Services"). The Site and the Services are made available to you under the following terms and conditions (these "Terms").

By accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you should not use or access this Site. We reserve the right to revise these Terms at any time by updating this posting. Your continued use of the Site after changes are posted constitutes your acceptance of those changes. Agreement to these Terms also constitutes your agreement to the NOVA Dance Competition Privacy Policy, which is incorporated herein by reference.

Use of the Site

Access to Features of Online Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable personal license to access and use the Site. We reserve the right, in our sole discretion and without notice to you, to revise the Services available on the Site and to change, suspend, or discontinue any aspect of the Site. We may also impose rules for and limits on the use of the Site or restrict your access to part, or all, of the Site without notice or penalty.

Use of Third-Party Offerings

You may access websites, content, registration platforms, products, or services provided by third parties through links made available on the Site (including but not limited to registration and media partners such as DanceBug or IMPACT Dance Adjudicators). We refer to all such websites, content, services, and products as "Third-Party Offerings." Your use of Third-Party Offerings is subject to the terms and conditions required by the applicable third-party provider(s). We are not the provider of, and are not responsible for, any Third-Party Offerings.

Payment Terms and Event Registration

When you register or select Services, you agree to pay the fees associated with your selections upon order confirmation. All payments will be processed in accordance with the billing method chosen. Payments made via third-party processors (such as Stripe, PayPal, or DanceBug billing solutions) are subject to the terms and privacy policies of those respective payment processors. You agree to pay all applicable prices, processing fees, and taxes at the time of order submission.

THE SITE, ALL INFORMATION, CONTENT, MATERIALS, AND SERVICES RELATED TO THE FOREGOING, AND THE SERVICES RECEIVED BY YOU ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW. WE AND OUR AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. WE DO NOT WARRANT THAT YOUR USE OF THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE. WE DO NOT GUARANTEE THE SECURITY OF ANY INFORMATION TRANSMITTED TO OR FROM THE SITE, AND YOU AGREE TO ASSUME THE SECURITY RISK FOR ANY INFORMATION YOU PROVIDE.

Limitation of Liability

USE OF OUR SITE AND SERVICES IS AT YOUR OWN RISK. IN NO EVENT WILL NOVA DANCE COMPETITION OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES IN CONNECTION WITH THESE TERMS, THE SITE, OR THE SERVICES, WHETHER FORESEEABLE OR NOT AND EVEN IF ADVISED OF THE POSSIBILTY OF SUCH DAMAGES. IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING IN CONNECTION WITH THESE TERMS OR USE OF THE SITE EXCEED THE GREATER OF (1) FIFTY DOLLARS (U.S. $50.00) OR (2) THE TOTAL AMOUNTS PAID BY YOU TO NOVA DANCE COMPETITION IN THE PRIOR SIX (6) MONTHS.

Indemnification

YOU AGREE TO INDEMNIFY, HOLD HARMLESS, AND DEFEND NOVA DANCE COMPETITION, ITS SUBSIDIARIES, DIVISIONS, AND AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, COSTS, AND EXPENSES OF DEFENSE, INCLUDING REASONABLE ATTORNEYS' FEES, ARISING FROM OR RELATED TO YOUR ILLEGAL USE OF THE SITE, YOUR VIOLATION OF THESE TERMS OR THE PRIVACY POLICY, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.

General Legal Terms

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any conflict of law principles that would require the application of the laws of another jurisdiction.

Dispute Resolution & Binding Arbitration

Any dispute or claim relating in any way to your visit to or use of the Site, the Services purchased, or your relationship with NOVA Dance Competition shall be resolved through confidential, binding arbitration in Pennsylvania under the Commercial Arbitration Rules of the American Arbitration Association. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL DISPUTES MUST BE ARBITRATED ON AN INDIVIDUAL BASIS AND NOT JOINED WITH OR CONSOLIDATED IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Any cause of action arising out of or related to the Site or these Terms must be filed within one (1) year after the claim arose; otherwise, such claim is permanently barred.

Severability and Modifications

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. We reserve the right to modify these Terms at any time. Changes will become effective thirty (30) days following notice or immediately upon posting for new users. Your continued use of the Site following posted changes indicates your agreement to be bound by the updated Terms.
